{"id":32254,"date":"2022-01-19T14:36:12","date_gmt":"2022-01-19T13:36:12","guid":{"rendered":"https:\/\/humanrights-online.org\/pashinjan-vyigral-v-espch-delo-protiv-armenii\/"},"modified":"2022-01-19T15:07:08","modified_gmt":"2022-01-19T14:07:08","slug":"armenian-pm-wins-case-against-armenia-in-strasbourg-court","status":"publish","type":"post","link":"https:\/\/humanrights-online.org\/uk\/armenian-pm-wins-case-against-armenia-in-strasbourg-court\/","title":{"rendered":"Armenian PM wins case against Armenia in Strasbourg court"},"content":{"rendered":"<div class=\"col3\">\n<p class=\"artikel\"><span style=\"color: #ffffff;\"><b>Armenian Prime Minister Nikol Pashinyan has won a case against the Armenian state in the European Court of Human Rights (ECHR) over his imprisonment a decade before coming to power.<\/b><\/span><\/p>\n<h1 class=\"wi-single-title\">Armenian PM wins case against Armenia in Strasbourg court<\/h1>\n<p class=\"intro\"><img decoding=\"async\" class=\" wp-image-32252 alignleft\" src=\"https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan.jpg\" alt=\"\" width=\"407\" height=\"229\" srcset=\"https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-31x17.jpg 31w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-200x113.jpg 200w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-355x200.jpg 355w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-400x225.jpg 400w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-600x338.jpg 600w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-768x432.jpg 768w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan-800x450.jpg 800w, https:\/\/humanrights-online.org\/wp-content\/uploads\/2022\/01\/pashinyan.jpg 940w\" sizes=\"(max-width: 407px) 100vw, 407px\" \/><\/p>\n<p>Pashinyan sued Armenia in 2010 over his arrest and conviction following the deadly 2008 crackdown on anti-government protesters.<\/p>\n<p>Pashinyan\u2019s government, as the respondent in the case, did not comment before the court on the allegations brought against it by the prime minister.<\/p>\n<p>In an 18\u00a0January judgement, the ECHR <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-215138\">ruled<\/a> that the Armenian authorities had violated Pashinyan\u2019s rights to freedom of expression, peaceful assembly, and to liberty and security.<\/p>\n<p>Pashinyan did not demand any material compensation in his application..<\/p>\n<p>The state was represented in the case by Yeghisheh Kirakosyan, who was appointed as Armenia\u2019s representative to the ECHR by Pashinyan\u2019s government in 2018, after briefly serving as an advisor to the prime minister.<\/p>\n<p>The ruling was the latest in a series of judgements by the ECHR against Armenia over the 2008 crackdown over numerous violations of the European Convention on Human Rights.<\/p>\n<h3>A deadly crackdown on the opposition<\/h3>\n<p>Pashinyan was arrested in July 2009 on charges of attempting to \u2018overthrow constitutional order\u2019. He was sentenced to seven years in prison but was released in 2011 in a pardon marking the 20th anniversary of Armenia\u2019s independence.<\/p>\n<p>He was convicted for his role in supporting protests against the results of the 2008 presidential election, which saw Robert Kocharyan coming to power.<\/p>\n<p>At the time, Pashinyan was an opposition activist and the editor-in-chief of <i>Haykakan Zhamanak<\/i> (the Armenian Times).<\/p>\n<p>The protests were organised in late February by Armenia\u2019s first president, Levon Ter-Petrosyan, who lost to Kocharyan in what the opposition claimed were rigged elections.<\/p>\n<p>At least <a href=\"https:\/\/www.hrw.org\/report\/2009\/02\/25\/democracy-rocky-ground\/armenias-disputed-2008-presidential-election-post-election\">ten people died<\/a>, including two police officers, when the authorities dispersed the protests on 1 March 2008.<\/p>\n<p>After coming to power in 2018, Pashinyan revisited the events of 1\u00a0March.
