They were attacked by thousands of homophobic counter-demonstrators led by Georgian Orthodox priests, eventually being evacuated by police. The authorities have repeatedly explicitly refused to protect demonstrations by queer rights campaigners since 2013.<\/p>\n<p>[Read more about 17\u00a0May 2013: <a href=\"https:\/\/oc-media.org\/voices\/16-18-may-2013-the-days-of-human-tragedies\/\">16\u201318 May 2013: the days of human tragedies<\/a>]<\/p>\n<p>The court found that Georgia violated three articles of the European Convention on Human Rights, the prohibition on inhuman or degrading treatment, the prohibition on discrimination, and the right to freedom of assembly.<\/p>\n<figure id=\"attachment_24879\" class=\"wp-caption aligncenter\" aria-describedby=\"caption-attachment-24879\"><a class=\"js-lightbox\" href=\"https:\/\/oc-media.org\/app\/uploads\/2021\/12\/17-May-2013-Tbilisi-Georgia-nettles-16-12-21.jpg\" data-caption=\"Women brandished nettles to attack queer rights campaigners. Photo:\u00a0Mariam\u00a0Nikuradze\/DFWatch.<\/figcaption><\/figure>\n<p>The court ruled that despite the authorities being aware of the danger that the demonstrators faced, they failed to make adequate security arrangements.<\/p>\n<p>\u2018Such failure to take effective measures had been compounded by evidence of official connivance, and even active participation in individual acts of prejudice\u2019, the court stated in a <a href=\"https:\/\/hudoc.echr.coe.int\/app\/conversion\/pdf\/?library=ECHR&amp;id=003-7211864-9802524&amp;filename=Judgment%20Women%E2%80%99s%20Initiatives%20Supporting%20Group%20and%20Others%20v.%20Georgia%20-%20unprecedented%20violence%20against%20LGBT%20demonstrators.pdf\">press release<\/a>.<\/p>\n<p>The court noted footage filmed by journalists showing police failing to respond to the violence, and in some cases, allowing the counter-protesters through their lines.<\/p>\n<p>\u2018[The court] was especially concerned by the images of senior officials, taking part in negotiations with the priests, remaining indifferent in the face of serious threats to public order.\u2019<\/p>\n<p>The court also condemned the lack of adequate investigation following the attack, which they said \u2018exposed the authorities\u2019 long-standing failure \u2014 perhaps unwillingness \u2014 to investigate homophobic and\/or transphobic violence.\u2019<\/p>\n<p>The ruling comes five months after a planned queer pride march in Tbilisi was called off when violent homophobic protesters once again took to the streets. Photo: Mariam Nikuradze\/OC Media.<\/figcaption><\/figure>\n<p>[Read more: <a href=\"https:\/\/oc-media.org\/georgian-authorities-fail-to-produce-autopsy-5-months-after-journalists-death\/\">Georgian authorities fail to produce autopsy 5 months after journalist&#8217;s death<\/a>]<\/p>\n<p>Tsiala Ratiani, a lawyer from WISG representing 16 of the applicants in Strasbourg, hailed the ruling, calling it a \u2018slap in the face\u2019 to the authorities.<\/p>\n<p>Ratiani told <i>OC\u00a0Media <\/i>it served as a reminder to the authorities that they were \u2018obliged to protect people gathered at rallies\u2019, adding that the government \u2018cannot restrict either the place of assembly or the time.\u2019<\/p>\n<p>\u2018I cannot say that after this decision the government will better defend people or repeat the same thing again, because people still go to demonstrations relying only on themselves, because they have less hope in protection from the state\u2019, she said.<\/p>\n<p>\u2018I was defending the people [\u2026] whose lives and health were then in real danger. I can boldly say that they looked death in the eyes\u2019, Ratiani said.<\/p>\n<p>She added that the demonstrators had only wanted to point out that there were many issues facing the queer community in Georgia.<\/p>\n<p>\u2018The state couldn\u2019t protect people from torture, couldn\u2019t ensure that this demonstration would take place so as not to endanger people\u2019s lives and health.
