The right to a fair trial, violated in the case of Petrenco group<\/h1><\/h1><\/div>

Amnesty International Moldova studied the copy of the conviction sentence, issued on\u00a028-th of June<\/strong>, by the Riscani Court on\u00a0Grigore Petrenco<\/strong>\u00a0and the\u00a08 co-protesters\u00a0<\/strong>case.<\/p>\n

Following the principle of the supremacy of human rights standards and international law in the case of legislative divergences, we found the given sentence is tendentious and containing the\u00a0following deviations from international standards:<\/strong><\/p>\n

1)<\/strong>\u00a0Art. 6 (right to a fair trial) of the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) requires \u201can independent and impartial tribunal to judge the cause within a\u00a0reasonable time<\/strong>\u201c, thus, the given reasonable time implies the preliminary investigation on criminal cases and examination in the first instance \u2013 no more than\u00a01 (one) year.<\/strong>\u00a0The given criminal case, including the investigation, was delayed for more than two years.<\/p>\n

2)<\/strong>\u00a0Arti. 6 of ECHR provides for fair sentences, corroborated by the size and gravity with the offense, i.e. \u2013 the\u00a0presumption of innocence<\/strong>\u00a0must be respected, or,\u00a0for missdemeanors \u00a0criminal penalties shall not be applied \/<\/strong>prison sentences\/.<\/p>\n

3)<\/strong>\u00a0Court decision violates\u00a0art. 11<\/em>\u00a0(freedom of assembly and association) of ECHR and provides for\u00a0\u201cjudicial control\u201d<\/strong>\u00a0\u2013 thus restricting the possibility of the activists to participate in peaceful public meetings and to express their ideas freely and publicly. Amnesty International Moldova reiterates that according to the decision of the\u00a0Nuremberg<\/em>\u00a0International<\/em>\u00a0Tribunal<\/em>, 3 types of behavior shall be restricted:\u00a0a) hate speech, b) racist speech, c) Nazi speech.<\/strong>\u00a0We are wondering, which of these three principles did Grigore Petrenco violate as he was restricted his constitutional rights?<\/p>\n

Amnesty International Moldova reiterates Moldovan justice system has not yet been reformed yet, is deficient in implementing human rights and unfairly applies art. 285 of the Criminal Code of the Republic of Moldova (mass disorder), without taking into account the positive practice of the EU states and avoiding the recommendations of the Council of Europe\u00a0on the necessity of<\/strong>\u00a0\u201chumanizing criminal penalties\u201d<\/strong>.<\/p>\n
