{"id":11037,"date":"2017-06-30T12:30:42","date_gmt":"2017-06-30T10:30:42","guid":{"rendered":"http:\/\/humanrights-online.org\/en\/?p=11037"},"modified":"2021-11-26T10:49:08","modified_gmt":"2021-11-26T09:49:08","slug":"the-right-to-a-fair-trial-violated-in-the-case-of-petrenco-group","status":"publish","type":"post","link":"https:\/\/humanrights-online.org\/hy\/the-right-to-a-fair-trial-violated-in-the-case-of-petrenco-group\/","title":{"rendered":"The right to a fair trial, violated in the case of Petrenco group"},"content":{"rendered":"<p><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 nonhundred-percent-fullwidth non-hundred-percent-height-scrolling fusion-equal-height-columns\" style=\"--awb-background-position:left top;--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-padding-top:20px;--awb-padding-bottom:20px;--awb-border-sizes-top:0px;--awb-border-sizes-bottom:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_2 1_2 fusion-one-half fusion-column-first\" style=\"--awb-padding-top:5%;--awb-padding-right:5%;--awb-padding-bottom:5%;--awb-padding-left:5%;--awb-bg-color:#f4f4f4;--awb-bg-color-hover:#f4f4f4;--awb-bg-size:cover;width:48%; margin-right: 4%;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\"><div class=\"fusion-title title fusion-title-1 fusion-sep-none fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:10px;--awb-margin-right-small:0px;--awb-margin-bottom-small:10px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h1 class=\"title\">The right to a fair trial, violated in the case of Petrenco group<\/h1><\/h1><\/div><div class=\"fusion-text fusion-text-1\"><p>Amnesty International Moldova studied the copy of the conviction sentence, issued on\u00a0<strong>28-th of June<\/strong>, by the Riscani Court on\u00a0<strong>Grigore Petrenco<\/strong>\u00a0and the\u00a0<strong>8 co-protesters\u00a0<\/strong>case.<\/p>\n<p>Following the principle of the supremacy of human rights standards and international law in the case of legislative divergences, we found the given sentence is tendentious and containing the\u00a0<strong>following deviations from international standards:<\/strong><\/p>\n<p><strong>1)<\/strong>\u00a0Art. 6 (right to a fair trial) of the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) requires \u201can independent and impartial tribunal to judge the cause within a\u00a0<strong>reasonable time<\/strong>\u201c, thus, the given reasonable time implies the preliminary investigation on criminal cases and examination in the first instance \u2013 no more than\u00a0<strong>1 (one) year.<\/strong>\u00a0The given criminal case, including the investigation, was delayed for more than two years.<\/p>\n<p><strong>2)<\/strong>\u00a0Arti. 6 of ECHR provides for fair sentences, corroborated by the size and gravity with the offense, i.e. \u2013 the\u00a0<strong>presumption of innocence<\/strong>\u00a0must be respected, or,\u00a0<strong>for missdemeanors \u00a0criminal penalties shall not be applied \/<\/strong>prison sentences\/.<\/p>\n<p><strong>3)<\/strong>\u00a0Court decision violates\u00a0<em>art. 11<\/em>\u00a0(freedom of assembly and association) of ECHR and provides for\u00a0<strong>\u201cjudicial control\u201d<\/strong>\u00a0\u2013 thus restricting the possibility of the activists to participate in peaceful public meetings and to express their ideas freely and publicly.
