The International Secretariat of the World\u00a0Organisation Against Torture (OMCT) requests your\u00a0URGENT<\/strong>\u00a0intervention in\u00a0the following situation in\u00a0the\u00a0Republic of Moldova<\/strong>.<\/p>\n

Brief Description of the Situation<\/strong><\/p>\n

The International Secretariat of OMCT has\u00a0been informed by reliable sources about the denial of\u00a0adequate medical care of Mr.\u00a0Serghei Cosovan<\/strong>, a 46-year-old Moldovan citizen, held in custody pending trial in Prison No.16-Pruncul, Chisinau, Moldova.<\/p>\n

According to the\u00a0information received, Mr. Serghei Cosovan, who is in the end-stage of liver cirrhosis, has been detained pending trial since 28 September 2017 without adequate medical treatment. Since his arrest, Mr. Cosovan\u2019s health condition has become dramatically worse and is in urgent need of a liver transplant. He has undertaken several surgeries while detained to stop the bleeding of his esophageal varices that occurs periodically. The last one was performed in February 2018.<\/p>\n

Mr. Cosovan\u2018s case has\u00a0been brought to the attention of the Moldovan Ombudsman. On 12 April 2018, experts of the Ombudsman\u2019s Office visited Mr. Cosovan and found that his state of health is constantly aggravated and that he needs a consultation of a hepatologist in order to initiate a liver transplant procedure. The experts have stated that the delay of this process could lead to an aggravation of his state of health and even his death. The liver transplantation is not possible to do since the Penitentiary No. 16 Pruncul and the Department of Penitentiary Institutions have no health care contracts signed with medical institutions that are specialized in the field of liver transplantology.<\/p>\n

The OMCT is gravely concerned about the\u00a0critical health condition of Mr. Serghei Cosovan and the vital threat\u00a0that the constant denial of adequate medical care represents. The OMCT calls on the\u00a0Moldovan authorities to\u00a0urgently guarantee the physical and psychological integrity of Mr.\u00a0Serghei Cosovan and immediately secure that he receives adequate medical care\u00a0through transferring him to\u00a0an\u00a0accredited medical public institution\u00a0specializing in severe hepatic disease and liver transplantation.<\/p>\n

The OMCT recalls the\u00a0Moldovan administration its responsibility to effectively ensure the\u00a0physical and psychological integrity of all persons deprived of liberty in\u00a0accordance with regional and international human rights law, and in particular\u00a0the European Convention on Human Rights, the\u00a0Convention against Torture and\u00a0Other Cruel, Inhuman or Degrading Treatment of Punishment, and the UN Standard\u00a0Minimum Rules for the Treatment of Prisoners.<\/p>\n


\nActions requested<\/strong><\/p>\n

Please write to the authorities of the Republic of\u00a0Moldova urging them to:<\/p>\n

    \n
  1. Guarantee, in all\u00a0circumstances, the physical and psychological integrity of Mr. Serghei Cosovan;<\/li>\n<\/ol>\n

    ii. \u00a0\u00a0 Order the immediate\u00a0transfer of Mr. Serghei Cosovan to an accredited medical public institution specializing in severe hepatic disease and liver transplantation where he can receive adequate medical examination and adequate\u00a0medical treatment for his disease;<\/p>\n

    iii. \u00a0 Ensure that adequate\u00a0conditions of detention and medical services are guaranteed to all persons that\u00a0have been deprived of liberty and detained in Moldova, according notably\u00a0to the UN Standard Minimum Rules for the Treatment of Prisoners;<\/p>\n

    1. Guarantee the respect of\u00a0human rights and the fundamental freedoms throughout the country in accordance\u00a0with national laws and international human rights standards.<\/li>\n<\/ol>\n
