Grenell also did not register under the Foreign Agents Registration Act, which generally requires people to disclose work in the U.S. on behalf of foreign politicians.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"1.2\" data-gtm-vis-recent-on-screen-452638_192=\"172957\" data-gtm-vis-first-on-screen-452638_192=\"172957\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">FARA is the same law that Trump\u2019s former campaign manager Paul Manafort and former deputy campaign manager Rick Gates were convicted of violating. (Manafort went to trial. Gates pleaded guilty.)<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"3.0\" data-gtm-vis-first-on-screen-452638_192=\"179455\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">It\u2019s not clear whether the articles were directly part of Grenell\u2019s paid consulting work for Plahotniuc. Unpaid work could still require disclosures under FARA if it was directed by or primarily benefited a foreign politician, according to Matthew Sanderson, a lawyer at Caplin &amp; Drysdale who advises people on complying with FARA. FARA contains several exemptions, such as for lawyers and businesses, Sanderson said, but none appear to apply to Grenell\u2019s op-eds about Plahotniuc.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"3.1\" data-gtm-vis-first-on-screen-452638_192=\"179524\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cThere is real reason to believe that Mr. Grenell should have registered here,\u201d Sanderson said after ProPublica described the circumstances to him. \u201cThis is exactly the type of circumstances I\u2019d expect the Department of Justice to investigate further.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"3.2\" data-gtm-vis-first-on-screen-452638_192=\"179856\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Craig Engle, an attorney with the law firm Arent Fox, said he was responding to ProPublica\u2019s questions on Grenell\u2019s behalf. Engle declined to say what Grenell\u2019s paid consulting work involved but said he did not have to register under FARA \u201cbecause he was not working at the direction of a foreign power.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"3.3\" data-gtm-vis-first-on-screen-452638_192=\"179922\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cRic was not paid to write these stories, in fact he has written hundreds of stories on his own time to express his own views,\u201d Engle said. \u201cBut to be clear: he was not working for any individual, he was working for himself and was advocating the ideal of a pro-western political party that was emerging.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"3.4\" data-gtm-vis-first-on-screen-452638_192=\"180005\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Undisclosed work for a foreign politician would ordinarily pose a problem for anyone applying for a security clearance or a job in a U.S. intelligence agency because it could make the person susceptible to foreign influence or blackmail, according to the <a href=\"https:\/\/www.dni.gov\/files\/NCSC\/documents\/Regulations\/SEAD-4-Adjudicative-Guidelines-U.pdf\">official policy<\/a> from the office that Trump tapped Grenell to lead.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.0\" data-gtm-vis-first-on-screen-452638_192=\"180355\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">The policy specifies that among the \u201cconditions that could raise a security concern and may be disqualifying\u201d are:<\/p>\n<ul>\n<li>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.1\" data-gtm-vis-first-on-screen-452638_192=\"180405\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cFailure to report or fully disclose, when required, association with a foreign person, group, government or country.\u201d<\/p>\n<\/li>\n<li>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.2\" data-gtm-vis-first-on-screen-452638_192=\"180439\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cSubstantial business, financial, or property interests in a foreign country \u2026 that could subject the individual to a heightened risk of foreign influence or exploitation or personal conflict of interest.\u201d<\/p>\n<\/li>\n<li>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.3\" data-gtm-vis-first-on-screen-452638_192=\"180505\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cActing to serve the interest of a foreign person, group, organization or government in any way that conflicts with U.S. national security interests.\u201d<\/p>\n<\/li>\n<\/ul>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.4\" data-gtm-vis-first-on-screen-452638_192=\"180706\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cThat\u2019s really easy, he should not have a clearance,\u201d said Kel McClanahan, a Washington-area lawyer specializing in security clearances. \u201cIf he were one of my clients and just a normal <div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 hundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-overflow:visible;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last fusion-column-no-min-height\" style=\"--awb-bg-size:cover;--awb-margin-bottom:0px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\">[federal employee], he would almost assuredly not have a clearance.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.5\" data-gtm-vis-first-on-screen-452638_192=\"180773\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">McClanahan said it\u2019s unclear how Grenell could have already gotten a clearance as an ambassador. <a href=\"https:\/\/oversight.house.gov\/news\/press-releases\/white-house-whistleblower-comes-forward-in-oversight-committee-investigation-of\">The House Oversight Committee<\/a> is investigating whether the Trump administration has overruled career officials in granting security clearances to political appointees.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.6\" data-gtm-vis-first-on-screen-452638_192=\"180955\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">As Trump\u2019s pick for acting director of national intelligence, Grenell will have access to the country\u2019s most sensitive secrets. Grenell isn\u2019t subject to Senate confirmation because Trump appointed him on a <a href=\"https:\/\/www.nytimes.com\/2020\/02\/20\/us\/politics\/grenell-trump-intelligence-director.html\">temporary basis<\/a>.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.7\" data-gtm-vis-first-on-screen-452638_192=\"181011\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">The White House, the Office of the Director of National Intelligence and the State Department did not immediately respond to requests for comment.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.8\" data-gtm-vis-first-on-screen-452638_192=\"181239\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Grenell, who is also continuing in his current posts as ambassador to Germany and special envoy for negotiations between Kosovo and Serbia, has gained Trump\u2019s favor with his unwavering loyalty and <a href=\"https:\/\/www.washingtonpost.com\/news\/world\/wp\/2018\/05\/09\/hours-into-his-new-job-trumps-ambassador-to-germany-offends-his-hosts\/\">combative tweets<\/a>. (In one instance, he <a href=\"https:\/\/twitter.com\/richardgrenell\/status\/1192190705743122433\">attacked<\/a> ProPublica in response to <a href=\"https:\/\/www.propublica.org\/article\/how-mike-pences-office-meddled-in-foreign-aid-to-reroute-money-to-favored-christian-groups\">reporting<\/a> that Vice President Mike Pence\u2019s office had intervened in foreign aid decisions.) He raised hackles in Berlin by injecting himself into the country\u2019s domestic politics, a departure from usual diplomatic protocol.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.9\" data-gtm-vis-first-on-screen-452638_192=\"181305\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Grenell does not have prior experience in intelligence. He was the U.S. spokesman at the United Nations during the George W. Bush administration.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.10\" data-gtm-vis-first-on-screen-452638_192=\"181555\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">In between his turns in government, Grenell had a public affairs consulting firm called Capitol Media Partners. One of the firm\u2019s clients, according to the <a href=\"https:\/\/projects.propublica.org\/trump-town\/staffers\/richard-grenell\">financial disclosure<\/a> that Grenell filed when he became an ambassador, was Arthur J. Finkelstein, the late Republican political consultant whose international clients included Prime Minister Benjamin Netanyahu of Israel and Prime Minister Viktor Orban of Hungary. Grenell\u2019s financial disclosure indicates that he received more than $5,000 from Finkelstein\u2019s firm but does not specify how much.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.11\" data-gtm-vis-first-on-screen-452638_192=\"181622\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">According to a person familiar with the relationship, Grenell worked for Finkelstein as a media consultant for clients in Eastern Europe. That person and another individual said the client in Moldova was Plahotniuc, the country\u2019s richest man and then a top official in its ruling political party.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.12\" data-gtm-vis-first-on-screen-452638_192=\"181871\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">In August 2016, Grenell published op-eds in the right-leaning <a href=\"https:\/\/www.washingtonexaminer.com\/russia-ramps-up-the-propaganda-machine\">Washington Examiner<\/a> and <a href=\"https:\/\/www.washingtontimes.com\/news\/2016\/aug\/10\/russia-still-offense-eastern-europe\/\">Washington Times<\/a> defending Plahotniuc and attacking his enemies as serving Russian interests. Plahotniuc and his allies at the time were fending off suspicions of their involvement in a $1 billion bank fraud in Moldova. \u201cBlaming the ruling party and its leadership has its political benefits for Russia,\u201d Grenell wrote in the Examiner article. \u201cPlahotniuc has been around Moldovan politics, business and civic life for decades and has turned out to be an easy target.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"5.13\" data-gtm-vis-first-on-screen-452638_192=\"182105\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">This narrative aligned with Plahotniuc\u2019s efforts to present himself as pro-Western in Washington and European capitals, according to lobbying disclosure records. \u201cCertainly there was an effort by him to engage U.S. officials at the time, that despite all this corruption he was the guy most likely to keep Russia at bay and therefore you should accept him,\u201d said Jonathan Katz, who oversaw U.S. aid programs for Moldova at the time. \u201cIt didn\u2019t match anything he was doing internally in the country,\u201d Katz said, because Plahotniuc didn\u2019t advance U.S. interests such as promoting democratic institutions and the rule of law.<\/p>\n<figure class=\"embed small left \" data-pp-id=\"6\" data-pp-blocktype=\"embed\" data-gtm-vis-first-on-screen-452638_192=\"182322\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Vladimir Plahotniuc&#8217;s corrupt actions undermined the rule of law and severely compromised the independence of democratic institutions in <a href=\"https:\/\/twitter.com\/hashtag\/Moldova?src=hash&amp;ref_src=twsrc%5Etfw\">#Moldova<\/a>. Today, I publicly designate him. The U.S. stands with Moldova in its fight against corruption.<\/p>\n<p>\u2014 Secretary Pompeo (@SecPompeo) <a href=\"https:\/\/twitter.com\/SecPompeo\/status\/1216750878948044806?ref_src=twsrc%5Etfw\">January 13, 2020<\/a><\/p><\/blockquote>\n<\/figure>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"7.0\" data-gtm-vis-first-on-screen-452638_192=\"182239\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Grenell was also quoted in an October 2016 <a href=\"https:\/\/www.houstonchronicle.com\/news\/politics\/us\/article\/Texas-congressman-wades-into-murky-Moldova-10415556.php\">article<\/a> in the Houston Chronicle criticizing a <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-resolution\/896\/text\">resolution<\/a> proposed by <a href=\"https:\/\/projects.propublica.org\/represent\/members\/W000814-randy-weber\">Rep. Randy Weber, R-Texas<\/a>, that accused Plahotniuc and his allies of corruption. \u201cHe\u2019s trying to attack the only pro-European group in Moldova,\u201d Grenell told the Chronicle.<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"7.1\" data-gtm-vis-first-on-screen-452638_192=\"182639\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">\u201cThe reality is he\u2019s pro-himself and nothing more,\u201d Valeriu Pa\u0219a, who leads a prominent civil society group in Moldova called WatchDog.MD, said of Plahotniuc. \u201cHe was playing both sides for 15 years at least.\u201d<\/p>\n<p data-pp-blocktype=\"copy\" data-pp-id=\"7.2\" data-gtm-vis-first-on-screen-452638_192=\"182671\" data-gtm-vis-total-visible-time-452638_192=\"100\" data-gtm-vis-has-fired-452638_192=\"1\">Plahotniuc lost power in 2019 and fled Moldova. His current whereabouts are unknown.
